Our terms for customers at any of our shops in the UK

  1. These terms
    1. What these terms cover. These are the terms and conditions on which we sell products to you at any one of our retail outlets in the UK. These are the terms and conditions referred to in notices within our stores.
    2. Why you should read them. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
  2. Information about us and how to contact us
    1. Who we are. We are Glenkeir Whiskies Limited a company registered in Scotland, trading as “The Whisky Shop” and/or “The W Club”and/or “The Whisky Shop Auctions”. Our company registration number is SC261795 and our registered office is at Suite 2 (Ground Rear), Melisa House, 3 Brand Place, Brand Street, Glasgow, G51 1DR . Our registered VAT number is 829 8429 79.
    2. Our website. Our retail website is at www.whiskyshop.com where you can find information on our products in store.  While we aim to have identical prices online, prices in store and on our website may from time to time vary.
    3. How to contact us. You can contact us by telephoning our customer service team at 0141 427 2977 or by writing to us at [email protected] or to our registered office.
    4. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
    5. “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.
  3. Age restrictions
    1. In the UK it is illegal for:
      1. any person under the age of 18 to buy (or to attempt to buy) alcohol for themselves or for any other person under the age of 18; and
      2. an adult to buy (or to attempt to buy) alcohol for any person under the age of 18.
    2. You may only purchase an alcoholic product from us if you are:
      1. at least 18 years old;
      2. not buying that product for any person or persons under the age of 18; and
      3. of legal age to purchase alcohol.
  4. Our products
    1. Products may vary slightly from their pictures. The images of the products on point of sale materials or on our website are for illustrative purposes only.  Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display will accurately reflect the appearance of  the product. Your product may vary slightly from those images.
    2. Product packaging may vary. The packaging of the product may vary from that shown in images on point of sale material or on our website.
    3. Tasting notes. The tasting notes on our website are written by our own tasting team.  However, different people will have a different experience of the same product as tasting is a subjective process.  The tasting notes do not form part of the description of any product.
    4. Measurements. All sizes, weights, capacities, dimensions and measurements indicated on product packaging have a small tolerance.  The size of this tolerance is set by reference to applicable legislation (including Regulation (EU) No. 1169/2011, Directive 76/211/EEC and The Weights and Measures (Packaged Goods) Regulations 2006), and varies from product to product and from one size, weight, capacity, dimension or measurement to the next.
    5. Changes to products. We may change a product from time to time to reflect changes in applicable laws and regulatory requirements or in order to implement minor technical adjustments and improvements.  We do not anticipate that these changes will materially affect your use or enjoyment of the product.
    6. Tasting From time to time, customers may be offered a sample to taste before purchase. Customers are advised to taste only small quantities of any sample, use the spittoon where provided and not finish any sample provided. Samples are not for consumption and are made available at the risk of the customer.
    7. Tasting events We offer in-store tasting events from time to time – these are ticketed events and by invitation only to the individual.  Tickets/invitations to tasting events are only transferable with our prior written consent.  Anyone attending a tasting event shall be at least 18 years old.  We reserve the right to ask for proof of age and to refuse admission. The purpose of such event is for the education, tasting and appreciation of individual spirit drinks and not for the consumption of alcohol. Attendees are advised to taste only small quantities, use the spittoon where provided and not finish any sample provided.  Over indulgence is not permitted and we reserve the right to refuse to offer sampling to any person. Any fee charged for attending a tasting is for the use of the premises and the time and attention of the staff conducting the tasting.
  5. Our contract with you
    1. We undertake to sell to you any item selected by you and presented to us at our payment counter at the price indicated by our automated till system, or otherwise advised to you at the time, provided the item is a stock item available for sale and not reserved for another purpose or for another customer; and there is no contravention of the applicable alcohol licencing laws.
    2. Different prices. We reserve the right to offer different pricing options to members of our W Club and to run special promotions online that are not available in store.
    3. Orders. We accept orders in store for out of stock products in exchange for the price of the product or a deposit. Payment of a deposit does not guarantee availability.  No sale shall take place until delivery of the product to you.  In the event of nonavailability, your deposit will be returned.  No interest is payable on deposits.
    4. Products available for ‘”pre-order”. If you order a product which we intimate as being available for “pre-order” or any similar expression or concept, we will seek to secure that product and dispatch it to you on or before any indicated expected date of dispatch.  The actual availability of any such product and/or its date of despatch is not guaranteed
    5. Cancellation of “pre-order products”. If you order a product which is highlighted as being available for “pre-order” or any similar expression or concept:
      1. you may cancel that order at any time before you receive a Dispatch Confirmation. If you choose to cancel your order, we will refund you the full amount (including any delivery costs charged) promptly;
      2. If we subsequently discover that we are unable to supply you with that product for any reason, we will advise you of its non-availability and refund the amount paid by you promptly.
    6. If we enter into any communication with you in relation to any product that we consider may be available for purchase we are not committed or bound to supply or procure any such product or until we have received full payment from you and issued a Dispatch Confirmation in respect thereof.
  6. Price and payment
    1. Where to find the price for the product. The price of the product (which includes VAT) will be normally displayed in store. We take all reasonable care to ensure that the price of the product advised to you is correct.
    2. What happens if we have got the price wrong. It is always possible that, despite our best efforts, some of the products we display may be incorrectly priced. We will normally check price on our automated till system the time of payment.  If an error is discovered we will advise and give you the option to choose another product or take the one selected at the amended price.
    3. When you must pay and how you must pay. We accept payment in sterling cash and with most major credit and debit cards.  We also take payment by inter-bank transfer and we reserve the right to insist on inter-bank transfer for products or orders of a value of more than £250, or such other amount as we may stipulate from time to time.  Payment will be taken when a product is dispatched or for “pre-order” products when an order is placed.
    4. Large cash sums. If payment in cash is offered in amounts more than £500, we reserve the right to ask for personal ID and take a copy of the ID proffered.
    5. Validation. To help to ensure that your credit or debit card is not being used without your consent, we may validate name, address and other personal information supplied by you during the order process against appropriate third party databases.  By accepting these terms you consent to such checks being made.  In performing these checks, personal information provided by you may be disclosed to a registered credit reference agency (which may keep a record of that information).  This is done only to confirm your identity.  A credit check is not performed and your credit rating will be unaffected.  All information provided by you will be treated securely and in accordance with the terms of our Privacy Policy.
  7. Our returns policy
    1. Returns It is not our policy to accept returns of products sold once they have left the store, but we do offer an exchange or a gift voucher of equivalent value to the original purchase.  All returns must be accompanied by the original till receipt.
    2. If a product is returned to store and in our opinion has been opened or tampered with or has suffered damage we will not exchange it or offer a gift voucher.
    3. You will be responsible for the cost of returning the product to us.
    4. If a product is faulty or has not been described accurately, or if we have given you the wrong product, that is not the one described in your till receipt, you have a legal right to reject that product.
    5. We reserve the right to refuse to take back a product if more than 6 months has elapsed since the date of sale.
  8. Shop opening hours
    1. Different branches of The Whisky Shop have different opening hours and these are published in store and online a www.whiskyshop.com
    2. We reserve the right to change our opening hours at any time without notice.
  9. Customer conduct
    1. Customers are expected to conduct themselves in a polite and orderly fashion when entering our store. We reserve the right to refuse to admit, refuse to sell to and eject any customer at any time..
    2. Photography in our stores is not permitted
    3. If a customer accidentally drops or breaks a bottle, no charge will be made. If a customer is reckless or wilful, we reserve the right to charge for breakages.
    4. The health and safety of our customers when they visit our stores is of paramount importance and we take all reason able steps to keep our stores safe.
  10. Jurisdiction
    1. These terms will be interpreted and receive effect according to the Law of Scotland.
